Preparation of a crime such as illegal crossing of the state border of Georgia and also illegal transfer of a migrant to the state border or creation of appropriate conditions for his stay in Georgia will become punishable under criminal law.

The draft amendments to the penal code, which was prepared by the Ministry of Internal Affairs, has already been initiated in the Parliament.

As the agency explains, at the initial stage of committing the mentioned crimes, in many cases important information about the deliberate creation of conditions for the commission of the crime becomes known to the investigative body, however, taking into account that the current code does not envisage the preparation of the mentioned crimes, reacting to such actions and taking effective measures against them is impossible.

At the same time, persons who request the status of international protection will be exempted from responsibility for illegally crossing the border. If the final decision determines that a foreigner or a stateless person does not need international protection, he will not be exempted from criminal responsibility.
